This Acceptable Use Policy applies to your (You or Your) use of the Service provided by 8seats Group Pty Ltd (ABN 40 652 350 402) (8seats). Capitalised terms used in this Acceptable Use Policy have the meanings given in the Terms of Use.
You must not, and must not permit any Invited User or any other person to, do any of the following:
- modify, make derivative works of, disassemble, decompile, reverse engineer, reproduce, republish or copy any part of the Service (including data structures or similar materials produced by programs);
- use any spider, robot or search/retrieval application or any screen scraping, data mining or similar data gathering device, process, program or means to access, retrieve or index any portion of the Service;
- engage in any action that requires, or may require, an unreasonable or excessively large load on the Service or its hardware infrastructure;
- access or use the Service to build or support, directly or indirectly, products or services that are competitive to the Service;
- license, sublicence, sell, transfer, assign, distribute, outsource, commercially exploit, permit timesharing or service bureau use of, or make available the Service to, any third party except as permitted by an agreement between You and 8seats;
- use the Service to store or transmit any computer code, file or script designed to damage (or detrimentally interfere with) the Service or any data including any virus, worm, time bomb or trojan horse;
- interfere with, or disrupt the integrity or performance of, the Service or third-party data contained within it;
- use the Service to violate any applicable Laws;
- access or use the Service to commit a fraudulent act;
- attempt to gain unauthorised access to the Service or its related systems or networks;
- with respect to the Service, perform or disclose any: performance or vulnerability testing, network discovery, port and service identification, vulnerability scanning, password cracking or penetration testing;
- perform or disclose any benchmarking, availability or performance testing of the Service;
- use the Service to:
- harass any person;
- engage in cyber-bullying;
- transmit, store or share:
- any non-consensual intimate images of a person;
- material that is pornographic;
- cyber-abuse material;
- material that promotes, incites, instructs or depicts abhorrent violent conduct or illicit drug use;
- material that is rated X18+ or R18+ under the Australian National Classification Scheme;
- child sexual exploitation and abuse material;
- material that advocates terrorism.
- engage in predatory conduct to prepare a child or young person for sexual activity at a later time;
- cause damage or injury to any person or property;
- promote dangerous ‘viral’ activities that have the potential to result in real injury or death;
- engage in hate against a person or group of people on the basis of race, ethnicity, disability, religious affiliation, caste, sexual orientation, sex, gender identity, disease, immigrant status, asylum seeker or refugee status, or age;
- promote bigotry, racism, hatred or harm;
- promote suicide or self-harm;
- publish any material that is false, defamatory, harassing or obscene;
- violate privacy rights;
- send unsolicited bulk e-mail or junk mail;
- infringe the intellectual property rights of any person;
- impersonate any person or entity or falsely state or otherwise misrepresent the Your affiliation with a person or entity;
- engage in conduct that is likely to deceive any person;
- cause annoyance, inconvenience or needless anxiety to any person; or
- engage in activity that is likely to upset, embarrass, alarm or annoy any other person.
8seats reserves the right to investigate any suspected violation of this Acceptable Use Policy. You must co-operate with any such investigation including by providing 8seats in a timely manner with all information reasonably requested by 8seats to enable it to conduct the investigation.
In addition to any other rights that 8seats has under its agreement with You or at law, 8seats has the right to take remedial action if the Acceptable Use Policy is violated, and such remedial action may include removing, disabling access to, or modify any material that violates this Acceptable Use Policy.
8seats may report any activity that it suspects violates any Law to any appropriate law enforcement authorities and regulators.
