- “Software” means our mobile, web and desktop based software-as-a-service application suite that facilitates online communication between its users (such as through direct and group-based messaging) for personal and business use as further described at www.8seats.com;

- “you” refers to any individual about whom we collect personal information.
We may change our Privacy Policy from time to time by publishing changes to it on our website and within our Software. We encourage you to check our website and Software periodically to ensure that you are aware of our current Privacy Policy.

2. What personal information do we collect?
Personal information includes information or an opinion about an identified individual or an individual who can be reasonably identified from the information or opinion. We may collect the following types of personal information:
- name;
- business mailing or street address;
- email address;
- mobile phone number and other contact details;
- your professional details (such as your job title and details of the business you represent);
- information about your employer or an organisation who you represent;
- your photograph (where you choose to upload this to the Software);
- the date and month of your birth;
- your gender;
- the approximate location (country, state and city) of the device using the Software which is derived from the device’s IP address;
- information necessary to perform our Services and respond to your enquiries;
- your qualifications, work history and background check information where you apply for a job position with us;
- information you provide to us through customer surveys; and/or
- any additional information relating to you that you provide to us directly via email or through our website or Services; and/or
- any other personal information that may be required in order to facilitate your dealings with us.
3. How do we collect personal information
We may collect the above types of personal information either directly from you or from third parties as follows:
- We may collect personal information directly from you when you:
- sign up or create an account for the Software;
- create or edit your profile in the Software;
- use the Software;
- register, submit or upload information on our website (such as an enquiry form); and/or
- communicate or interact with us including via correspondence, chatbots, emails, the Software (including in-app messages) or when you share information with us from other social applications, services or websites.
- We may also collect personal information about you from other sources, for example from:
- other Customers or prospective customers;
- your employer (such as where they are a Customer);
- public databases and social media platforms (like Facebook, Instagram, LinkedIn, Twitter and other platforms);
- third party suppliers and contractors who assist us to operate our business; and/or
- third party applications or services where a Customer integrates or links such third party application or service with our Software.
- When you apply for a job or position with us we may collect personal information directly from you and from any recruitment consultant, your previous employers and others who may be able to provide information to us to assist in our decision on whether or not to make you an offer of employment or engage you under a contract.
If you do not provide us with your personal information, we may not be able to:
- provide you (or the entity that you act on behalf of) with our Services;
- communicate with you;
- help you recover access to your account (where it has been lost);
- provide you with technical support;
- respond to your enquiries and/or
- progress your job application.
4. Employee record exemption
In accordance with the Privacy Act, this Privacy Policy does not apply to our acts and practices directly related to:
- a current or former employment relationship between us and an employee; and
- an ‘employee record’ (as defined by the Privacy Act) held by us relating to the employee, (Employee Record Exemption).
Personal information which does not fall within the Employee Record Exemption will be dealt with by us in the same way as any other personal information pursuant to the Privacy Act and this Privacy Policy.
5. Why do we collect, hold, use and disclose personal information?
We may collect, hold, use and disclose your personal information for the following purposes:
- to enable you to access and use our website;
- to enter into, and perform, contracts with Customers;
- to provide the Services to Customers;
- to communicate with Customers;
- to notify Customers of new or changed services offered;
- to provide Customers with requested technical support for the Software;
- to send Customers marketing and promotional messages and other information that may be of interest to them;
- to send Customers service, support, administrative messages, reminders, technical notices, updates, security alerts and any other information requested by Customers;
- for our billing, payments and debt recovery purposes;
- for our internal data analytics purposes (such as to help us understand usage of the Software by geographic location and usage trends of the Software);
- to comply with our legal obligations, resolve any complaints or disputes that we may have with any of our users or Customers and to enforce our agreements with third parties; and/or
- to consider your employment application.
6. To whom do we disclose your personal information?
We may disclose your personal information for the purposes described in this Privacy Policy to:
- third party suppliers, contractors, subcontractors and service providers so that they may perform services for us or on our behalf;
- our professional advisers and agents;
- payment systems operators, billing operators or debt recovery agents;
- anyone to whom our assets or businesses (or any part of them) are transferred;
- third party applications or services where a Customer integrates or links such third party application or service with our Software;
- specific third parties authorised by you to receive information held by us; and/or
- other persons as required, authorised or permitted by law (including government agencies, regulatory bodies and law enforcement agencies).
7. Disclosure of personal information outside Australia
We may disclose your personal information to our third party suppliers, contractors, subcontractors and service providers who are located outside the borders of Australia for the purposes outlined in this Privacy Policy. Those third party recipients are likely to be located in the Philippines and the United States of America.
8. Using our website, links, integrations and cookies
- While we do not use browsing information to identify you personally, we may record certain information about your use of our website, such as which pages you visit, the time and date of your visit and the internet protocol address assigned to your computer.
- We may use 'cookies' or other similar tracking technologies on our website that help us track your website usage and remember your preferences. Cookies are small files that store information on your computer, mobile phone or other device. They enable the entity that put the cookie on your device to recognise you across different websites, services, devices and/or browsing sessions. 9. How do we hold your personal information?
We store most information about you in computer systems and digital databases operated by either us or our external service providers. We take reasonable steps to protect your personal information from misuse, interference and loss, as well as unauthorised access, modification or disclosure. We implement and maintain technical and organisational measures to protect your personal information. However, we cannot guarantee the security of your personal information.
We take reasonable steps to destroy or de-identify personal information that is no longer needed for the purpose for which it was collected or as required by law.

You will not be charged for making a request to access your personal information but you may be charged for the reasonable time and expense incurred in compiling information in response to your request. We may also need to verify your identity when you request your personal information.
- Sometimes, we may not be able to provide you with access to all of your personal information and, where this is the case, we will tell you why.
- If you think that any personal information we hold about you is inaccurate, please contact us and we will take reasonable steps to ensure that it is corrected.

We will acknowledge your complaint and respond to you regarding your complaint within a reasonable period of time.
